1. Our Services

Welcome to Fastoprox, operated by Ferolt India Pvt Ltd ("Fastoprox", "we", "our", or "us"). These Terms and Conditions govern your access to and use of the Fastoprox website, applications, APIs, AI agents, automation services, and related products and services (collectively, the "Services").

By accessing or using our Services, you agree to these Terms. If you are using Fastoprox on behalf of a company or other organization, you confirm that you have the authority to accept these Terms on its behalf.

Fastoprox provides AI-powered agents, automation, communication, workflow, and related software services. Features may include conversational AI, voice and messaging agents, workflow automation, integrations, analytics, and other AI-assisted functionality.

Our Services may change over time as we improve, update, add, or remove features. We may also release experimental or beta features that are provided subject to additional terms.

2. Your Account

You are responsible for maintaining the security of your account credentials, API keys, passwords, and other authentication information.

You must provide accurate information when creating an account and must promptly update information that becomes inaccurate.

You are responsible for activity performed through your account unless that activity resulted from unauthorized access caused by a failure on our part to maintain reasonable security.

3. Your Content

You retain ownership of the information, documents, messages, files, prompts, instructions, recordings, and other content that you submit to Fastoprox ("Your Content").

You grant Fastoprox a limited, non-exclusive license to host, store, process, transmit, and otherwise use Your Content only as reasonably necessary to provide, secure, maintain, and improve the Services, comply with applicable law, prevent abuse, and provide customer support.

We do not claim ownership of Your Content.

Where applicable, Fastoprox may also process Your Content through third-party infrastructure or service providers required to operate the Services. Such providers are subject to appropriate contractual and security obligations.

4. AI-Generated Output

Fastoprox uses artificial intelligence and machine-learning technologies. AI-generated responses, content, recommendations, classifications, transcriptions, summaries, and other outputs may be inaccurate, incomplete, outdated, or inappropriate for a particular purpose.

You are responsible for reviewing and validating AI-generated outputs before relying on them, particularly where decisions may have legal, financial, medical, employment, safety, or other significant consequences.

Fastoprox does not guarantee that generated output will always be accurate, unique, reliable, or suitable for your intended use.

5. Acceptable Use

You may use Fastoprox only in accordance with these Terms and applicable law.

You must not:

Use the Services for unlawful, fraudulent, deceptive, abusive, or harmful activities.

Attempt to gain unauthorized access to our systems, accounts, networks, or data.

Interfere with or disrupt the operation or security of the Services.

Reverse engineer, decompile, or attempt to extract source code from the Services except where permitted by law.

Use the Services to infringe intellectual property, privacy, publicity, or other rights of another person.

Use AI agents or automated systems in ways that violate applicable laws or regulatory requirements.

Circumvent usage limits, security controls, or access restrictions.

Submit information that you do not have the right or lawful basis to provide.

We may suspend or terminate access where we reasonably believe the Services are being misused or used in violation of these Terms.

6. Third-Party Services

Fastoprox may integrate with third-party platforms, APIs, communication providers, cloud services, payment providers, and other external services.

Your use of such services may be governed by their own terms and privacy policies. Fastoprox is not responsible for the availability, security, accuracy, or performance of third-party services outside our reasonable control.

7. Fees and Payments

Certain Fastoprox Services may require payment.

Pricing, billing cycles, usage limits, credits, subscriptions, taxes, refunds, and payment conditions will be disclosed during purchase or in the applicable service agreement.

Unless otherwise stated, fees already incurred are non-refundable except where required by applicable law or expressly agreed by Fastoprox.

We reserve the right to change pricing with reasonable advance notice.

8. Intellectual Property

Fastoprox and its licensors retain all rights, title, and interest in the Services, including software, interfaces, designs, trademarks, logos, documentation, technology, and other Fastoprox materials.

These Terms do not transfer ownership of Fastoprox intellectual property to you.

You receive only the rights necessary to access and use the Services in accordance with these Terms.

9. Confidentiality

Each party may receive confidential or non-public information belonging to the other party.

The receiving party will use reasonable care to protect confidential information and will use it only for purposes connected with the Services or applicable business relationship.

Confidentiality obligations do not apply to information that is publicly available, independently developed, lawfully received from another source, or required to be disclosed by law.

10. Security and Data Protection

Fastoprox uses reasonable technical and organizational safeguards designed to protect information processed through the Services.

Depending on the service and configuration, safeguards may include encryption in transit, access controls, authentication mechanisms, monitoring, logging, backups, and security procedures.

No internet-based service can guarantee absolute security. You remain responsible for protecting credentials, API keys, integrations, and access permissions associated with your account.

11. Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate your access where reasonably necessary to protect the Services, enforce these Terms, address security or abuse concerns, comply with law, or where payment obligations remain outstanding.

Upon termination, your right to use the Services will end. Certain provisions, including intellectual property, confidentiality, limitations of liability, and applicable dispute provisions, may continue after termination.

12. Disclaimer

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that the Services will always be uninterrupted, error-free, secure, or available at a particular time.

We do not guarantee the accuracy or reliability of AI-generated content.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Fastoprox will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings arising from or related to use of the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, legal requirements, or business practices.

When changes are material, we will provide reasonable notice through the Services, our website, or other appropriate communication.

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Any disputes will be subject to the jurisdiction of the courts having competent jurisdiction in India, unless otherwise agreed in a written agreement between Fastoprox and a customer.
